Local doctor, hospital asked to pay compensation for botched surgery

An ophthalmologist and Bharani Hospitals, Saligramam on Arcot Road were directed to pay Rs.5 lakh as compensation to a 62-year-old man who lost one of his eyes after undergoing a cataract surgery in 2005 at this hospital.

This award was granted recently by the Chennai South District Consumer Disputes Redressal Forum.

It ruled that A. K. Balakrishnan lost his eye as the operation theatre was not sterilized. It was stated that a piles operation was conducted in the same theatre just before performing the cataract surgery.

Dr S Venkatesh, who was running a clinic at Virugambakkam had conducted the surgery on Balakrishnan in Bharani Hospital.

But Balakrishnan developed irritation in the eye and he was later treated at Sankara Nethralaya. There, doctors found the lens was contaminated and the eye could not be cured. And so Balakrishnan’s left eye had to be removed.

Venkatesh had later put the blame on the Hospital, claiming that the operation theatre was not properly sterilised, leading to the infection.

The Forum ordered the doctor to pay Rs.1 lakh and the hospital to pay Rs.4 lakh to Balakrishnan as compensation.
